How to report copyright infringement on the Pluse platform.

1. Overview

Emmber, Inc. (“Pluse,” “we”) respects the intellectual property rights of others and expects users of the Pluse platform to do the same. This page explains how to submit a notice of alleged copyright infringement under the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and the counter-notification procedure.

2. Designated Agent for DMCA Notices

Pluse has designated the following agent to receive notices of claimed copyright infringement. Notices submitted to anyone other than the designated agent below may not result in expedited review.

Pluse maintains the designated agent above to receive DMCA notices in accordance with 17 U.S.C. § 512(c)(2). The United States Copyright Office’s public DMCA Designated Agent Directory can be searched at copyright.gov/dmca-directory.

3. How to Submit a DMCA Notice (Takedown Request)

If you believe that material on Pluse infringes your copyright, you may submit a notice to our designated agent above. A valid DMCA notice must include all of the following, per 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered, a representative list is acceptable.
  3. Identification of the material claimed to be infringing and the precise location (URL or other identifier) sufficient to allow Pluse to locate it.
  4. Your contact information: full legal name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Notices may be sent by email to dmca@pluse.to or by mail to the designated-agent address above. We strongly prefer email for faster handling.

4. What Happens After You Submit a Notice

Upon receipt of a complying notice, Pluse will:

5. Counter-Notification

If you believe your content was removed from Pluse in error (for example, because it does not infringe, because you have the right to use it, or because the removal was the result of misidentification), you may submit a counter-notification under 17 U.S.C. § 512(g)(3) to our designated agent.

A valid counter-notification must include all of the following:

  1. A physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where the material appeared before it was removed.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full legal name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Pluse may be found), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

Upon receipt of a compliant counter-notification, Pluse will forward it to the original complainant. If the complainant does not file an action seeking a court order against the subscriber within 10 to 14 business days of being forwarded the counter-notification, Pluse will replace the removed material or cease disabling access to it, consistent with 17 U.S.C. § 512(g)(2)(C).

Penalty of perjury. Both DMCA notices and counter-notifications are submitted under penalty of perjury. Knowingly submitting a false notice or counter-notification may result in liability for damages, including costs and attorneys’ fees, under 17 U.S.C. § 512(f).

6. Misuse of the DMCA Process

Pluse takes abuse of the DMCA process seriously. Submitting false or bad-faith takedown notices, including notices intended to suppress lawful speech or competition, may result in:

Consistent with 17 U.S.C. § 512(i), Pluse maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. A user who is the subject of multiple valid DMCA notices that result in removal of material may have their account suspended or terminated.

8. Reservation of Rights

Pluse reserves the right to (i) remove allegedly infringing material at its discretion in response to a notice that does not strictly comply with the DMCA, (ii) reinstate material it believes was removed in error, and (iii) take any other action it deems appropriate, including reporting alleged infringement to law-enforcement authorities.

9. Trademark, Right of Publicity, and Other Claims

This page addresses copyright claims only. For trademark, right-of-publicity, defamation, or other intellectual-property or content-related concerns, please email Contact@pluse.to with the subject line “IP Complaint” and include comparable identifying and good-faith information.

10. International Notices

For copyright complaints arising outside of the United States, please use the same designated agent. We will evaluate the notice under the DMCA and applicable equivalent local law. Pluse’s response does not constitute a waiver of any defenses available to it under applicable law.
